The implementation of the administrative procedure is regulated by Article 48 of the Law of the Republic of Belarus No. 105-3 of January 4, 2010 “On the Legal Status of Foreign Citizens and Stateless Persons in the Republic of Belarus”.
Authorized bodies - Departments of Citizenship and Migration of the bodies of internal affairs of the Republic of Belarus.
Competent authority - Ministry of Internal Affairs of the Republic of Belarus.
The administrative procedure is carried out in relation to:
· foreign citizens
· stateless persons
Provided that they have a temporary residence permit in the Republic of Belarus.
Features of obtaining:
· A foreigner's temporary residence permit in the Republic of Belarus is confirmed by a mark “Temporary residence permit (Dazvol na chasovaje prazhyvanne)”, which is issued in accordance with the procedure established by the Council of Ministers of the Republic of Belarus
· A foreigner temporarily residing in the Republic of Belarus is obliged to reside in the Republic of Belarus only at the place of temporary residence for which he/she has been issued a temporary residence permit
· When changing the place of temporary residence, a foreigner temporarily residing in the Republic of Belarus is obliged, within three working days from the date of arrival at the new place of temporary residence, to apply to the citizenship and migration department at the new place of temporary residence to make changes to the mark “Temporary residence permit (Dazvol na chasovaje prazhyvanne)”.
IMPORTANT! A temporary residence permit may be issued to family members of a foreign citizen or stateless person who has obtained or is obtaining a temporary residence permit, provided he/she has a legal source of income that ensures a minimum subsistence level for himself/herself and his/her family members, as established in the Republic of Belarus, for the period of consideration of the application for a temporary residence permit, for the duration of their stay, but not exceeding the validity period of the temporary residence permit of the foreigner who has received or is receiving a temporary residence permit
An application for an administrative procedure can be submitted:
· through the single portal of electronic services → Е-Pasluga with non-strong authentication
· by personally visiting the registering authority → Territorial Citizenship and Migration departments
The application must be submitted within three working days of arriving at the new temporary place of residence.
Example:
If you arrive at your new place of residence on Tuesday, you must submit your application to the citizenship and migration office at your new place of residence no later than Thursday.
The days off for territorial units for citizenship and migration are Sunday and Monday.
To submit an application for the administrative procedure, it is necessary to:
1. authorize on the UPES via not-strong authentication (by login-password or using external authentication services (Аpple, Google);
2. the administrative procedure will be available in the personal electronic account;
3. fill in the electronic application form with the required documents attached and submit the application to the authorized body for consideration and administrative decision-making.
Documents on the basis of which the application is completed:
· Passport / Travel document / Certificate confirming the identity of a foreign citizen or stateless person / Certificate of subsidiary protection / Certificate of registration of an application for refugee status, subsidiary protection, or asylum / Refugee certificate
(data is entered as indicated in the document):
- Only in Russian→ write in Russian
- Latin available → use it
- IMPORTANT! The data must match the information provided when applying for a temporary residence permit
· Documents confirming the possibility of residing at the place of intended temporary residence.
Files (pdf, jpg, jpeg, png, tiff) — up to 10 MB in total
The decision is made within 1 working day from the date of submission an application
Free-of-charge in accordance with the legislative acts of the Republic of Belarus (laws, orders, decrees of the President of the Republic of Belarus)
Foreign citizens or stateless persons for the purpose of registering temporary residence in the Republic of Belarus
The result of the implementation of the administrative procedure – an electronic message:
an administrative decision on refusal to accept the application of an interested person;
an administrative decision on refusal to implement the administrative procedure;
an administrative decision on implementation the administrative procedure.
